These Terms & Conditions govern your use of this website and any enquiries or services provided by Amy Breur. By accessing this website, submitting an enquiry or engaging my services, you agree to these terms.

1. About this website

This website showcases my portfolio, services and content creation work, including UGC, photography, videography, drone content and content libraries.

Information on this website is provided for general informational purposes and may be updated or changed at any time.

2. Enquiries and bookings

Submitting an enquiry through this website does not create a binding agreement or guarantee availability.

A project will only be considered confirmed once the scope of work, deliverables, pricing, usage rights and relevant terms have been agreed in writing and any required deposit or payment has been received.

Project timelines and availability may vary depending on the scope of the project, travel requirements and current workload.

3. Pricing and quotes

Prices shown or discussed are indicative unless confirmed in a written quote or agreement.

Final pricing may vary depending on factors including:

  • number and type of deliverables

  • filming or photography requirements

  • travel requirements

  • turnaround time

  • revisions

  • content usage

  • paid advertising usage

  • licensing period

  • exclusivity

  • whitelisting or creator advertising

  • raw footage

  • drone requirements

  • additional production requirements

Quotes are valid for the period stated in the quote.

4. Payments

Payment terms will be provided with each quote, invoice or project agreement.

Work may not begin until any required deposit or upfront payment has been received.

Final content may be withheld until outstanding invoices have been paid in full.

Late or unpaid invoices may result in project delays or suspension of services.

5. Revisions

The number of revisions included will be stated in the relevant package, quote or agreement.

Requests outside the agreed scope, additional revisions or changes to an approved concept may incur additional fees.

A revision means reasonable changes to the existing content and does not include a complete reshoot, new concept or significant change in creative direction unless otherwise agreed.

6. Usage rights and licensing

Unless otherwise agreed in writing, ownership of the original content remains with Amy Breur.

Clients receive usage rights in accordance with the licence agreed for the specific project.

Usage may be limited by:

  • platform

  • purpose

  • geographic market

  • organic or paid use

  • duration

  • advertising rights

  • exclusivity

  • whitelisting

  • third-party usage

Content must not be used outside the agreed licence without written approval and, where applicable, an additional usage fee.

Perpetual usage or full buyouts are not included unless specifically agreed in writing.

7. Portfolio use

Unless confidentiality or exclusivity has been agreed in writing, I may display completed work in my portfolio, website, social media channels, pitch materials and other promotional materials.

If a project must remain confidential, this should be discussed before the project begins.

8. Client responsibilities

Clients are responsible for providing accurate and timely information, including brand guidelines, briefs, product details, claims, deadlines and any required approvals.

The client is responsible for ensuring that any claims, statements, instructions or information supplied for use in the content are accurate, lawful and approved for publication.

Delays in providing information, products or feedback may affect the agreed project timeline.

9. Products and materials

Where products are supplied for content creation, responsibility for postage, delivery, customs or related costs will be agreed before the project begins.

Unless otherwise agreed, products supplied for content creation are not guaranteed to be returned.

I am not responsible for delays caused by lost, damaged or delayed deliveries outside my reasonable control.

10. Travel and location-based projects

Travel-related projects may involve additional costs, including transport, accommodation, permits, location fees or other reasonable expenses.

These costs will be agreed before the project is confirmed.

Weather, location access, travel disruption or other circumstances outside my control may require filming dates or deliverables to be adjusted.

11. Drone content

Drone services are subject to weather conditions, location restrictions, airspace requirements and applicable aviation rules.

Drone filming cannot be guaranteed in every location.

Where required, additional permissions, approvals or location fees may apply.

If drone filming cannot safely or legally take place, an alternative approach may be discussed.

12. Cancellations and rescheduling

Cancellation and rescheduling terms may vary depending on the project and will be outlined in the relevant quote or agreement.

Deposits, booking fees, travel costs or work already completed may be non-refundable.

Where a project is cancelled after work has commenced, payment may be required for work completed up to the cancellation date.

13. Creative discretion

Every effort will be made to create content in line with the agreed brief, creative direction and brand requirements.

Creative work is subjective, and specific performance outcomes cannot be guaranteed.

While content may be created with goals such as increasing engagement, enquiries, bookings or sales, no guarantee is made regarding views, reach, conversions, revenue or other platform or business results.

14. Intellectual property

All original concepts, scripts, footage, photographs, edits and creative materials remain protected by intellectual property rights unless otherwise agreed in writing.

Clients may not resell, redistribute, alter, license or provide the content to third parties outside the agreed usage rights.

15. Website content

All content on this website, including text, photographs, videos, branding, graphics and portfolio work, is owned by or licensed to Amy Breur unless otherwise stated.

It may not be copied, reproduced, republished or used commercially without written permission.

16. Third-party links

This website may contain links to third-party websites, platforms or social media accounts.

I am not responsible for the content, availability, security or privacy practices of third-party websites.

17. Limitation of liability

To the maximum extent permitted by law, Amy Breur is not liable for indirect, incidental or consequential loss arising from the use of this website or services.

Nothing in these terms excludes rights or remedies that cannot legally be excluded.
